What is an H-1B visa?

The H1B visa is a nonimmigrant work visa that allows U.S. companies to employ specialists who provide services in one of the specialty occupations.

The H1B visa is a dual-intent visa, work visa holders can apply for a permanent residency (a green card) by filing Form I-485. It is recommended to start the process sooner rather than later. Once your H-1B Visa expires, you may have difficulties with your green card application.

Can I bring my family with an H-1B visa?

Yes, you may bring your closest relatives (a spouse or unmarried children under the age of 21). Members of your family can accompany you to the U.S. under an H-4 visa.

Who can apply for an H-1B visa?

For employees:

The U.S. government has the following requirements for H 1B visa applicants (you must comply with at least one of them):

  • A completed bachelor’s degree or higher in the field of the specialty occupation from an accredited university
  • A foreign degree which is equivalent to a bachelor’s degree or higher in the field of the specialty occupation
  • Unrestricted state license or certification in the field of the specialty occupation in the state of prospective employment
  • Have verifiable and recognized education, experience, or training in the specialty that is equivalent to the completion of a bachelor’s degree or higher

Who can apply for an H-1B visa?

For employers:

A U.S. employer may file this petition for an alien employee if the job meets the following requirements or more:

  • The usual minimum entry requirement for the position is a bachelor’s degree or higher.
  • A degree is normally required for the specified position in the given industry or the degree requirement is predetermined by the complexity of the job.
  • A degree or its equivalent is normally required for the position by the employer.
  • A degree requirement is predetermined by the nature of the specific duties which cannot be performed without specific knowledge usually associated with attainment of a bachelor's degree or higher.

What documents and application items do I need to apply for an H1 B visa?

  • Form I-129 work visa application
  • Evidence proving that all the applicable fees have been paid by both the employer and the employee
  • Documents proving that the prospective employee meets the qualification requirements (copies of diplomas/certifications)
  • A copy of the prospective employee's passport
  • A copy of the signed contract between the employer and employee
  • Internal Tax Returns of the company
  • A report of state wages paid to employees
  • 15 photographs of the business location

U.S. government fees are mandatory and nonrefundable:

  • Labor Certification Fee, paid by the employer: $2,000 - $5,000
  • USCIS filing fee for Form I-129: $460
  • USCIS biometric services fee: $85
  • Visa fee for all H-visa types, paid by the intended employee outside of the U.S.: $190
